These Terms of Use are applicable to all users of FINKI CLOUD ("the service"). Users should read, understand and accept these Terms when accessing this service. If a given user has not done this, or does not agree with the contents of these Terms of Use, that user should not create an account on the Website and should not make use of any of the services provided via this service.
By accepting these Terms of Use, the user enters into an agreement with UKIM, FCSE ("the service provider") made up by the contents of these Terms, in order to regulate the user’s access and use of the service. Users which accept these Terms of Use hereby represent and warrant that:

The following cloud services are provided:
Users must first register before using the service. Two registration options are supported:
In both cases, users must be explicitly approved after completing the registration process and before gaining access to the service. The registration is valid for a period of 1 year, starting from the date it has been submitted. Afterwards, users are provided with the option of extending their registration.
Suspension. If the user becomes aware or is notified by UKIM, FCSE that any application, project, or user data violates the Terms of Use, the user will immediately suspend the application or project and/or remove the relevant user data (as applicable). If the user fails to comply with UKIM, FCSE’s request to do so within twenty-four hours, then UKIM, FCSE may disable the project or application, and/or disable the account (as may be applicable) until such violation is corrected.
Voluntary termination. Users may terminate this agreement at any time by stopping the use of the service and deleting their account and any associated resources.
Termination for Breach. Either party may terminate this agreement for breach if: (i) the other party is in material breach of the agreement and fails to cure that breach within thirty days after receipt of written notice; or (ii) the other party is in material breach of this Agreement more than two times notwithstanding any cure of such breaches.
Termination for Inactivity. UKIM, FCSE reserves the right to terminate the service for inactivity, if, for a period exceeding 180 days, user: (a) has failed to access the Admin Dashboard; and (b) a project has no active virtual machine or storage resources, or an application has not served any requests.
Termination of Expired Accounts. UKIM, FCSE will remove any existing accounts that are not renewed for an additional year after expiration, including all resources associated with these accounts.
Each registered user will be allocated a limited compute, storage, and networking capacity. The predefined quotas for these resources are:
Users shall not use any method to circumvent the provisions of these Terms of Service, or to obtain services in excess of those for which they contract with UKIM, FCSE. Users shall only use those compute, memory, storage resources and IP addresses that are assigned to them by UKIM, FCSE, and shall not use any IP addresses outside of their assigned range. Users shall not use any mechanism to exceed the amount of resources assigned to them through the service, or to conceal such activities.
Users may not use the service in violation of the copyrights, trademarks, patents or trade secrets of third parties, nor shall they utilize the service to publish such materials in a manner that would expose them to public view in violation of the law.
UKIM, FCSE might provide software to subscribers that is subject to third party licensing and terms of use agreements. UKIM, FCSE will ask subscribers to accept these conditions in order to use the software. In case this software is upgraded or improved, subscribers will be asked to accept the license and terms of use of the upgraded version. The transfer of such licenses outside the platform is prohibited.
Users are the only ones responsible to ensure that the software which they deploy on the virtual machines under their control is used abiding to the license and terms of use of the IPR owner of the software.
UKIM, FCSE does not bear any responsibility for the content and data distributed through the service. The responsibility on the legitimacy and lawfulness of the content/data or the means of their usage remains exclusively on the user.
UKIM, FCSE will take all necessary measures in order to prevent any abuse, arbitrariness, damage, content, and data loss; however, UKIM, FCSE does not warrant that such a possibility does not exist in any case and does not bear any responsibility in such an event. Users must guard their data performing their own backups to deal with risks of losses.
UKIM, FCSE takes all necessary measures to achieve the availability of the service; however, UKIM, FCSE does not provide any availability warranty in any case such that it can be held accountable and/or responsible for direct or indirect damages which are due to loss of the service for any time period.
UKIM, FCSE cannot be held accountable and/or responsible in any case whatsoever for the data and content loss distributed through the service as well as for any relevant damage. Moreover, UKIM, FCSE does not guarantee nor bears any responsibility for the accuracy of the data and of the content available through its service.
Opinions expressed or texts published through the service do not represent in any case whatsoever official opinions of UKIM, FCSE, which cannot be held responsible for its content.
According to personal data protection laws, UKIM, FCSE, does not control or monitor in any way the content of the distributed information and of the distributed data, so UKIM, FCSE disclaims any kind of responsibility for eventual distribution on its network, products, services or through which the ownership or distribution constitutes copyright infringement or other offence.
UKIM, FCSE will make every possible effort to maintain the continued and reliable operation of the service. Notwithstanding, UKIM, FCSE can stop providing the service or modify their deployment configurations at any time without prior notification. Interrupting the provisioning of the service immediately blocks their use by users, without implying any rights to indemnification.
